SEPARATE OPINIONS AND THEIR RELEVANCE TO THE JUDICIAL PRACTICE OF THE ECHR – SOME REFLECTIONS BASED ON THE JURIDICAL EXPERIENCE RELATING TO THE BEGINNING OF HUMAN LIFE AND PLANNED REFORMS

Abstract

Although separate opinions are not specific to the continental system the already exists in the jurisprudence of international courts and in the ECHR. The aim of the considerations presented in this article is to answer the question how these opinions are formed in relation to matters related to the beginning of human life. The analysis includes the presentation of the institution of separate opinion and its functioning on the basis of the ECHR. The content and distinctive elements of the separate opinion prepared in matters of bioethics were also emphasized. The importance of the arguments of the judges, the materials used by them, and those elements that they attempted to complete in the judgment has also been analyzed. The final part includes the challenges which can appear for institution of separate opinion in the context of the entry into force the Additional Protocol No 16 and the admissibility of the preparation of advisory opinions. From the point of view of bioethical issues, which includes wide margin of appreciation these challenges appear to be particularly serious.
