Judicial Activism of the European Court of Human Rights and the Structural Deficits of the ECHR System

Abstract

This contribution aims to persuade that judicial activism – occurring in the ECtHR less often than commonly perceived – is an inherent feature of the Court in accordance with the original intention of the Parties to the Convention. In this contribution the notion of judicial activism is understood as referring to the instances of changing the existing interpretative standard of the convention within the limits of interpretative consensus. This contribution enumerates some of the structural deficits of the ECHR system and analyses the impact of the judicial activism thereon. The conclusion highlights the risk of – quite frequently advocated recently – restraining the judicial activism of the ECtHR, referring also to Protocol No 15 amending the ECHR.
