Are Blogs Really the Press? Some Practical Remarks on the Legitimacy of Recognising Bloggers as Journalists and Blogs as the Press

Abstract

The purpose of the author of this article is an attempt to assess the legitimacy of recognising a blog as a form of the press in accordance with the Act of 26 January 1984 – Press Law. Although the topic has already been a subject of numerous statements of legal doctrine and literature in the field of media sciences, as well as judicial decisions, the diversity of presented positions confirms that the topic requires further analysis and discussion. Many of the assessments presented so far raise serious doubts. This is related, among other things, to the fact that it is still problematic – not only for lawyers, but also for media experts – to define what a blog really is and who bloggers are. Therefore, the author not only undertakes to find a solution to the title problem, but in the first place, based on his own research, makes an attempt to outline the shape of the contemporary Polish blogosphere showing the features that distinguish bloggers from other groups publishing in the mass media. The final conclusions indicate that bloggers cannot be considered to be journalists nor blogs as the press.
