Dialogue or monologue? Acts of respect and Ketubahs as forms of family communication in 19th-century notarial deeds from Podlasie
Abstract
The article focuses on differences in linguistic and legal interactions between parties of notarial deeds of different nationalities – Poles and Jews. It presents the dialogic structure of acts of respect and marriage licenses as well as the monologic message of ketubahs
– traditional premarital agreements in the Jewish community, in the sphere of family
communication. The analysis is based on the corpus of archive sources from the legal
offices in Łuków run by Stanisław Lipnicki, Józef Kalasanti Szaniawski (1810–1811)
and Ludwik Modrzewski, who served in Siedlce (1833). The study illustrates also broader
social phenomena such as the coexistence of ethnic groups, tensions between tradition
and the modernization of law, as well as the mechanisms of constructing ethnic identity.
Acts of respect represent an interactive dialogue: children’s requests for their parents’
blessing and the latter’s response in the form of permission to get married, which reflects
changes in family law related to the Napoleon Code. Ketubahs, on the other hand, based
on the Talmud, are unilateral declarations emphasizing the hierarchical nature of family
relationships and the preservation of Old Testament traditions. The opposition proposed
in the title – “dialogue or monologue” – also reflects the limits of assimilation: Polish
acts are an attempt to adapt to the new legal order, while Jewish acts serve as a bastion
of tradition, protecting cultural and religious autonomy from external legal interference.
The article integrates linguistic (pragmatics of communication), sociological (dynamics
of family relations), and historical (impact of legal codification) perspectives, emphasizing
the role of language as a medium for negotiating cultural and familial values.
