The obligation to implement standards for the protection of minors in light of Article 72(1) of the Polish Constitution
Abstract
The aim of the publication is to review the new legal provisions for the protection of children from abuse, i.e. standards for the protection of minors, in force since February 15, 2024. Under the amended law of May 13, 2016, on preventing the threat of sexual offences and the protection of minors, several new obligations have been imposed on providers of services to children. According to the will of the legislator, their implementation is intended to counteract the use of various forms of violence against children. The amendment should be considered in light of Article 72(1) of the Polish Constitution, which imposes an obligation on public authorities to protect the rights of the child, including above all against violence, cruelty, exploitation and demoralization. The effectiveness of the adopted legal solutions will depend on their application in practice, although divergences in the interpretation of the provisions are already apparent at this stage. The publication uses the dogmatic-legal method to analyze the regulations.
