„Aesthetic expropriation” – its admissibility and demands with regard to future law
Abstract
The aim of the article is to discuss the possible actions that public authorities, particularly local authorities, can take with regard to the aesthetics of the areas under their jurisdiction, in accordance with the current legal framework. It also highlights the growing expectation of a significant proportion of citizens that public authorities should take care of the aesthetics of these areas. The article identifies the legal tools available to meet these expectations and explores the possible actions that can be taken under the law to ensure the safety of people and buildings. It concludes by highlighting the inability to take action in undeveloped areas. Consequently, the article proposes changes to future legislation aimed at providing the public administration with more effective legal means of action without violating the values protected by supra-legal acts.
