„New” criminal law protection of human health from exposure to infection by a biological pathogen (Article 161 of the Penal Code). Remarks after 27 years of the Penal Code of June 6, 1997
Abstract
The spread of infectious diseases poses a formidable legislative challenge for any legislator. Most often in the field of administrative law. However, several regulations relating to the protection of human life and health from the said phenomenon can be encountered in criminal law. One such case is Article 161 of the Penal Code, criminalizing exposure to infection with a biological pathogen causing a contagious disease, venereal disease, severe incurable or real life-threatening disease. This provision existed in various forms in the Penal Codes of 1932 and 1969. In the currently effective Penal Code of 1997, the title provision remained unchanged, and the scope of criminalization of the aforementioned behaviour lived to see renewed attention of the legislature only in 2020, after the outbreak of the global COVID-19 pandemic. However, it seems that the amended provision of Article 161 of the Penal Code does not satisfy the doubts that have accumulated over the years as to its functioning in the criminal law system. The publication presents a historical outline of the formation of the title regulation accompanied by the views of the criminal law doctrine. On this level, inaccuracies related to the practical application of the regulation of Article 161 of the Penal Code are shown. In addition, the views of the criminal law doctrine were confronted and de lege ferenda postulates were derived as to its further functioning. The primary purpose of the article is to establish the legitimacy of the existence of Article 161 of the Penal Code in confrontation with the ratio legis arising from the conviction of the Polish legislator regarding the criminalization of behavior involving deliberate exposure to infection by a biological pathogen causing an infectious disease. The scientific goal of the work also correlates with the strong social need for adequate protection of individual and public health from the dangers associated with the spread of infectious diseases.
