Abstract

This article is aimed at presenting the issue of a citizen complaint to an administrative court. The right to bring this legal measure is provided for in the provisions of all three acts regulating the local government system, i.e. Art. 101 of the Act on Municipal Self-Government, Art. 87 of the Act on Poviat Self-Government and Art. 90 of the Act on voivodeship self-government. The article aims to analyze and evaluate the legal regulations regarding this institution and to show the benefits of its use, in particular the fact that through it citizens have the opportunity to participate in local government decision-making processes. The article presents the objective scope of a citizen’s complaint, the substantive scope of the complaint, as well as the effect of applying this legal measure. It also points out possible problems related to the application of this legal institution. The work also analyzes the case law of administrative courts developed in the context of the above-mentioned provisions. The analysis of the case law regarding the consideration of citizens’ complaints by courts has shown that although the basis for a complaint may be a violation of the complainant’s particular interest, however, the argumentation of the objections raised (both by the complainants and the court) very often refers to legal aspects of general importance, and in particular to the limits within which local government bodies using the authorizations granted to them to make decisions in particular types of cases must fit. Therefore – as a result of these complaints – the administrative courts set these limits for local government bodies and influence the content of future decisions and the procedure for making them. On this basis, a conclusion was formulated that these complaints should be treated as a manifestation of citizens’ influence on the decisions of local government bodies.
