Requirements and procedure for pursuing a claim for payment of benefits for providing accommodation and food to citizens of Ukraine

Abstract
The benefit for providing accommodation and food to Ukrainian citizens staying in the territory of the Republic of Poland in connection with hostilities conducted in the territory of Ukraine was one of the types of assistance provided for by the provisions of the Act of March 12, 2022, on assistance to citizens of Ukraine in connection with an armed conflict in the territory of that country. The legislator, apart from Art. 13 U.P.O.U. and the Regulation of the Council of Ministers on the maximum amount of cash benefits for providing accommodation and food to citizens of Ukraine and the conditions for granting this benefit and extending its payment, did not provide detailed rules for determining whether the applicant meets the conditions for granting the benefit. The article analyzes the conditions for the payment of the benefit and the period of its payment. Additionally, the legal nature of the benefit itself was indicated, as well as the jurisdiction of common courts and administrative courts to consider applications for payment of benefits. The ordinary courts are only competent to hear disputes arising from the refusal to pay benefits. All other disputes must be submitted to the administrative courts.
