The object of the executive act of the offence under Article 126 of the Code of Offences

Abstract
The legislator, as part of the protection of private property and personal rights, penalises not only the offence of destroying or stealing someone else’s tangible property, but also the offence consisting in the theft, appropriation, destruction, or damage of someone else’s item of non-material value. The text organises the views of legal scholars regarding the object of the executive act in the offence defined in Article 126 of the Petty Offences Code and relates them to case law. Additionally, the author addresses the issue of sentimental value in the context of the discussed offence and analyses its significance for the interpretation of the provision.
