A A proposal for terminological reforms regarding the criminalisation of child sexual abuse material (CSAM) in Polish criminal law
Abstract
This article aims to analyse the terminological approaches de lege lata in the laws criminalising Child Sexual Abuse Material (CSAM) and to propose de lege ferenda recommendations that will account for the need for terminology changes in the Polish Criminal Code. The following research questions were posed: 1. What is the relationship between Polish and international legislation regarding the terminology in the context of CSAM? 2. What changes in Polish legislation can be proposed in the direction of the unification of terminology on CSAM? The terminological solutions concerning CSAM adopted in Polish legislation against the background of international regulations in this area were analysed to identify potential inconsistencies and areas in need of reform. In the final part of the study, the author presents de lege ferenda proposals for introducing the term “child sexual abuse material” and its definition into the Criminal Code.
