Rules for legalising the operation of 24-hour nursing homes for the elderly
Abstract
The process of population ageing in Poland has contributed to the development of the private sector in the provision of welfare services to the elderly. In accordance with the provisions of the Act of March 12, 2004, on social assistance, entrepreneurs who meet the requirements under this act obtain a permit from the locally competent voivode to conduct this type of activity, which is publicised through an entry in a register kept by this authority. The article aims to demonstrate that this form of legalisation is necessary and that the requirements for entities applying for a decision in this regard are high, which is closely related to the type of services provided by 24-hour care homes. The publication shows the source of the need to develop the private sector in the provision of care and living services for the elderly. It also discusses the rules related to the legalisation of such facilities. An analysis of the regulations relating to 24-hour nursing homes shows that the process of legalising them requires the fulfilment of several conditions relating both to the entrepreneur starting this type of activity and to the place where the facility is to be run. In the author’s opinion, it is necessary to consider whether the requirements relating specifically to the equipment of the living room in a 24-hour care home take into account the individualised needs of the person using it.
