Responsibility for non-implementation of the standards for the protection of minors in a Catholic parish – selected topics
Abstract
The obligation to introduce standards for the protection of minors remains one of the instruments intended to prevent and protect children. The legislator presented a wide catalogue of entities that are obliged to properly implement the Standards. The parish of the Catholic Church was not excluded from the group of those obliged. The aim of the work is to determine the natural person responsible for implementing the standards for the protection of minors in the parish, including the tasks of the body representing the parish, as well as the entities authorised to carry out inspections regarding the implementation of the standards for the protection of minors in the parish. The analysis made it possible to determine that the obligation to implement the standards rests with the parish priest, as the body of a legal person. It was assumed that the term introduction should be understood broadly – not only as preparation and publication, but also as actual implementation of the rules of behaviour. It was also indicated that the Police remain the only entity authorised to control the implementation of the standards.
