Legal framework for the operation of citizen energy communities

Abstract

The research objective of this article is to analyze the legal framework for the operation of citizen energy communities in Poland in the context of Directive (EU) 2019/944 of the European Parliament and of the Council of 5 June 2019 on common rules for the internal market in electricity and amending Directive 2012/27/EU, to the extent that it obliges Member States to create a new entity, namely a citizen energy community, and to identify selected legal barriers based on this framework. The research was conducted using dogmatic legal and comparative legal methods. The starting point was to determine the status and scope of activities of citizen energy communities. It was established de lege lata that the solutions adopted by the Polish legislator regarding the possibility of choosing the organisational form of operation of citizen energy communities are based on the examples listed in Directive 2019/944, provided that they meet certain requirements. The de lege lata analysis also concluded that the solutions introduced in the Energy Law Act meet the fundamental objectives set for Member States in Directive 2019/944. However, legal barriers remain that discourage the creation of citizen energy communities. Despite existing legal solutions, according to the list maintained by the President of the Energy Regulatory Office, only one citizen energy community operates in Poland, operating in the form of an association. Therefore, de lege ferenda proposals were identified to help remove the perceived legal barriers limiting the development of CEC.
