Legal protection of a child’s image in the digital environment
Abstract
This article examines the legal issues surrounding the dissemination of children’s images in the digital environment, with particular emphasis on the role played by parents and legal guardians. On the one hand, they are the primary decision-makers in matters concerning the child’s privacy; on the other, they are legally and ethically obliged to act in the child’s best interests. The purpose of the article is to assess the adequacy of the existing legal framework – both constitutional (in particular, Articles 47 and 72 of the Polish Constitution) and statutory – considering the rapidly evolving digital landscape. The analysis addresses, among other things, the concept of image as a personal good under civil law, the protection of image under copyright law and the GDPR, as well as the legal requirements related to consent for the dissemination of a child’s image, considering the child’s age and the legal authority of the parent. The article also highlights the risks associated with publishing children’s images online, including the growing phenomenon of sharenting. In conclusion, children’s right to privacy on the Internet is not sufficiently protected by Polish law, even though it is referred to by both constitutional and statutory provisions. The study is based on the traditional dogmatic-legal method, involving the analysis of legal acts and scholarly literature.
