Selected problems of the proceedings in the case of having disciplinary liability against academic teachers, students and doctoral students
Abstract
The text is devoted to the analysis of provisions contained in the Law on Higher Education and Science concerning the position of academic teachers, university students, and doctoral students facing disciplinary charges. The purpose of this text is to analyse the solutions applicable in disciplinary proceedings and their compliance with criminal procedure solutions, as those that best satisfy the need for guarantees for the persons participating in them. The text points to the staging of disciplinary proceedings and the related heterogeneity of the legislator’s approach to the status of the person against whom such proceedings are conducted. A number of institutions related to the right of defence of the accused are discussed, pointing to their connection with their criminal procedure counterparts, but also to the shortcomings of statutory solutions that may affect the effectiveness of the defence. The author notes the incompleteness of certain procedural solutions, but also the redundancy of some of them in situations where they repeat solutions from the Code of Criminal Procedure, even though the provisions of the latter code are, via Article 305, Article 320 and Article 322(1) in conjunction with Article 320 of the Law on Higher Education and Science, applied accordingly in disciplinary matters.
