Premises and form of the mayor’s opinion on the mining plant’s operation plan. Critical commentary on the final judgment of the Voivodship Administrative Court of February 4, 2025, case No. III SA/Po 604/24
Abstract
The purpose of this comment is a critical analysis of the judgment of the Provincial Administrative Court of 4 February 2025 (III SA/Po 604/25). The Geological and Mining Act stipulates that an application for approval of the mining plant’s operation plan must be accompanied by an opinion of the head of the municipal community (mayor, town mayor, city mayor). Its premise is the intended use of the property, as specified primarily in the spatial development plan. Consequently, it should be assumed that the aforementioned opinion was issued before the commencement of the proceedings leading to a decision on the approval of the aforementioned plan. There are no grounds for giving it the form of a resolution in the meaning of Article 106 of the Code of Administrative Procedure, which was not recognised by the authorities adjudicating in the case and the administrative court.
