Abstract

This commentary is a commentary on the judgment of the Provincial Administrative Court in Olsztyn of October 3, 2024, case file II SA/Ol 621/24. The commentary presents not only the reasoning of the issuing court, but
also the reasoning presented in other judgments of the Supreme Administrative Court and Provincial Administrative Courts that have issued rulings in similar cases. The above arguments were also reinforced by rulings of supervisory authorities and numerous legal perspectives. The provisions of the Act of January 31, 1959, on Cemeteries and Burial of the Deceased were analysed in the context of the possible legal regulations that municipal governments may issue regarding the establishment of fees for burial-related activ-
ities. The conclusion of the commentary is as follows: local government bodies, without express statutory delegation, cannot establish (and cemeteries cannot establish) any fees that are unrelated to the burial of the deceased, such as fees for maintaining a deceased person in a pre-paid grave,entry to the cemetery, and cemetery use. Cemeteries may only charge fees related to the burial of a body, and therefore, establishing fees for other
activities is unlawful
