The Lithuanian state’s refusal to recognise a neopagan religious community. Romuva’s case before the European Court of Human Rights
Abstract
The European Court of Human Rights, in its ruling in the case of Romuva v. Lithuania from 2021, found that by refusing state recognition to this community, the Lithuanian authorities had not provided a reasonable and objective justification for treating this community differently from other religious organisations. According to the Tribunal’s assessment, the principle of neutrality and impartiality of state bodies in matters of worldview was not observed, and the Ancient Baltic Association Romuva fulfilled all the requirements set by the legislator for the recognition of this religious organisation by the state. Therefore, it was unanimously found that there had been a violation of Article 14 in conjunction with Article 9 and Article 13 of the European Convention on Human Rights. The aim of the article is to present the case of a pagan community in Lithuania and the difficulties in obtaining full rights on an equal footing with other religious communities.
