Forms of centralisation of municipal procurement, taking into account legal and institutional solutions
Abstract
The importance of public procurement concentration, especially in the form of planned aggregation, is obvious. A significant increase in efficiency results from the pooling of expenditures by multiple contracting entities that decide to award joint contracts of higher value. In addition to significant financial reductions, bureaucratic savings and various other benefits resulting from the stabilisation of contractual ties are also significant, especially in the long term. However, the literature and case law lack in-depth considerations in this area, which undoubtedly constitutes one of the (cognitive) barriers hindering more advanced cooperation between contracting entities, even if only in procurement, not to mention the still modest practical appeal of joint public procurement. Only in relation to joint government procurements can we find a few doctrinal statements, as well as increasing practical integration of some contracting authorities, especially shaped from above with the participation of treasury units. However, visible deficiencies are revealed in the local government sector, both in terms of potential forms of cooperation. Therefore, this study aims to partially fill this publication gap.
