Abstract

Both- the parties and the legal doctrine are interested in joint phisical custody.Indeed, given the transformations in family law, it is worth considering whether it is justified to maintain the status quo, and therefore the discretion to adjudicate these matters based on the general child welfare clause, or whether the conditions for applying these requirements should be explicitly listed to facilitate the work of judges and, above all, to implement the principles arising from family law.
