PROTECTION OF THE AUTHORS' RIGHTS UNDER THE COPYRIGHT ACT

OF THE 29th OF MARCH 1926

 

The purpose of this article is the presentation of the Polish legislation concerning the protection of copyright laws in the light of the Act of the 29th of March 1926. Minimum standards of protection in this matter are indicated. The Act of 1926 was of an original character. It was based on the latest developments of foreign law, and it was very highly praised by both the Polish and foreign professionals in this field of law. It was emphasized that many of its provisions were ahead of normative institutions adopted in other countries, which were related to copyright (such as the Romanian Act of 1923 and Italian Act of 1925 or Czechoslovak Act of 1926). Its main advantages were: a very broad object of protection, flexible and very clear definition of the object of copyright, synthetic approach to the content of copyright law formulated according to the model of ownership, synthetic copyright protection of personal (moral) rights as rights, which were indispensable, perpetual, and independent.
