Abstract
There is currently no definition of a civil partnership in Polish legislation. There are also no provisions directly referring to the settlement of partners’ property. Unlike in the case of marriage, there are no legal regulations which would help assess the settlement of the partners’ property relationships. However, the lack of regulations on civil partnerships does not mean that people remaining in such relationships cannot jointly acquire property or that after the dissolution of the relationship, they cannot divide it. Polish legislation has developed a well-established line of jurisprudence to this effect, which allows other civil law mechanisms to be used in this situation.
In practice, partners most often do not arrange their property relations according to specific patterns, they do not enter civil law contracts with each other, and they largely agree implicitly on this issue. The partners may acquire assets through acquisition by one of them either in fixed shares or as part of a civil partnership after having previously entered it. To avoid settlement problems, it could be possible to find a single, universal basis for property settlements for the various forms of informal living, which could offer more practical solutions than a tangle of various types of individual civil law contracts. The purpose of this article is to analyse the current case law on settlements between former partners and to try to find the best solution for making these settlements based on the rules introduced on this subject in France.
