The specificity of the crime of unlawful deprivation of liberty committed in organised criminal groups in light of the results of file examination
Abstract
The crime of unlawful deprivation of liberty may be committed by individual perpetrators who are repeat offenders, as well as by those acting for the first time. It may also be committed by members of organised criminal groups. This article aims to present the results of file research conducted regarding the above-mentioned crime in the context of its specificity, when the perpetrators are recruited from the so-called organised crime. The general goal is therefore to attempt to characterise unlawful deprivation of liberty based on the conducted file research. The issues examined to formulate conclusions concerned the profile of the perpetrators and victims, establishing the relationship between them, determining the motivation of the perpetrators, and the circumstances of committing the crime and the demonstrated modus operandi. The analysis of criminal case files allowed, for example, to establish that in most of the examined cases, the perpetrators operated in several isolated places, used cars to transport victims, and employed various violent behaviours. The main driving force behind the perpetrators’ actions was money, broadly understood.
