Invalidation of the proceedings in the selection of EU projects for co-financing
Abstract
The invalidation of the procedure is an institution known from public procurement, the function of which is the possibility of ending it without selecting a contractor. It is of particular importance in a situation where the performance of the order is not in the public interest or when the procedure is burdened with a legal defect that prevents the conclusion of a contract for the award of the order, which cannot be challenged. The legislator decided to introduce a similar solution to the implementation act regulating the procedure for selecting projects for co-financing from European funds, guided by a similar ratio legis. The article aims to analyse the grounds for invalidating the procedure in the scope of selecting projects co-financed from European funds, to assess the correctness of their formulation and the admissibility of their interpretation, following the views of the case law and doctrine developed based on the application of the Public Procurement Law. In the course of the argument, the fundamentally correct formulation of the grounds for invalidating the procedure was established and de lege ferenda postulates were presented concerning, among others: the applicant’s claim for reimbursement of justified costs of participation in the procedure, the introduction, under the Public Procurement Law, of the institution of invalidating the co-financing agreement in the event of a legal defect in the procedure, and the regulation in the implementation act in the next programming period of issues related to judicial and administrative control of the correctness of the application of the grounds for invalidating the procedure.
