The evolution of criminal liability for unauthorized construction in Polish Construction Law
Abstract
Unauthorised construction, as a legal phenomenon, was first regulated in Polish legislation at the beginning of the twentieth century. With the development of urbanisation and the growing importance of spatial order, the legislator recognised the need to control the investment process. In the initial period, the perpetrator of unauthorised construction bore criminal liability exclusively under misdemeanour law, which entailed a more lenient regime of responsibility – most often in the form of a fine or detention. Over time, in response to the increasing scale of illegal developments and the need for more effective law enforcement, the legislator decided to tighten the sanctions. Unauthorised construction ceased to be treated solely as a misdemeanour and, upon satisfying specific statutory requirements, was also classified as a criminal offence, becoming so only as of 1994. Since 2020, unauthorised construction – given its characterisation as an act of relatively low social harm – has again been treated as a misdemeanour. The aim of the article is to present legislative changes and to determine whether criminal liability for unauthorised construction is contingent upon the prior issuance of an administrative decision by the construction supervision authority. In summary, despite changes in the legal qualification of the act, doctrine and case law consistently hold that criminal (currently misdemeanour) liability for committing unauthorised construction does not depend on the issuance of an administrative decision. The circumstances surrounding unauthorised construction may be the subject of both administrative proceedings and misdemeanour proceedings. These proceedings are autonomous, differing in the sanctions imposed on the offender and in their respective functions with respect to the factual situation.
