Court’s ex officio decision in proceedings for the division of marital property after the termination of the marital property regime (Article 567 § 1 and 3 in conjunction with Article 684 of the Code of Civil Procedure) regarding claims arising from the unjustified disposal of assets of the marital estate by one spouse before the termination of the marital property regime in judicial practice
Abstract
This article aims to examine the legal framework governing settlements in proceedings for the division of marital property after the dissolution of the statutory community of property. Particular attention is given to cases in which one spouse, before the termination of the regime, unjustifiably disposed of assets belonging to the community (for example, through sale, expenditure, or dissipation). The study addresses both the substantive legal basis of such claims and the procedural duties of the court, with a focus on whether the adjudication of these issues should occur ex officio or only upon a party’s motion. The analysis is grounded in the case law of the Supreme Court of Poland and highlights the implications for the protection of spousal property rights and the coherence of judicial practice.
