Earthworks (excavations) or mineral extraction?
Abstract
The subject of this paper is the expansion of the arguments presented by G. Lubeńczuk in his article The obligation to obtain a licence to extract minerals from deposits and the separation of minerals from deposits in connection with construction works (“Studia Prawnoustrojowe” 2025, No. 70, pp. 231–247). As a rule, mining of minerals from deposits requires a licence. Exceptions, where it is possible without a licence, are of small practical significance and can be disregarded. Details regarding licensing, however, may be very disputable. There is no statutory definition of “mineral” or its “extracting”, and the definition of “deposit” may be subject to varying interpretations. However, during earthworks, especially excavations (e.g. for construction purposes), minerals are separated from their natural accumulations. Obtaining a licence to extract minerals from deposits is extremely time-consuming and requires significant financial outlay. Depending on the type of mineral and the location of its deposit, it must be preceded by numerous decisions (permitting its prospecting and exploring, on environmental conditions, approval of geological documentation, a resolution of the municipal council on the spatial development plan, etc.). It is therefore not surprising that many investors attempt to circumvent these requirements. Illegal mining of minerals (especially aggregates) is becoming a common phenomenon. Such activities are subject to an increased fee (in essence, an administrative fine). This raises the question of whether every removal of minerals from their natural accumulations requires a licence, and whether this also applies to earthworks (excavations) carried out for other purposes (construction, water management, etc.). The case law of administrative courts is quite strict in these matters and assumes that any separation of a mineral from its natural accumulation constitutes its extraction. If this is done without a licence, the fee must be imposed. It is difficult to agree with this type of assessment. Whether the investor intends to extract minerals from a deposit or to carry out earthworks should be determined by the actual intention of the person conducting such activity.
