Establishing the principles for granting subsidies by provincial assemblies for works on historical monuments – reflections on resolutions adopted in 2020–2025
Abstract
The provincial assembly is authorised to establish, by resolution, the principles for granting subsidies from the provincial budget for conservation, restoration, or construction work on a monument entered in the register or included in the municipal register of monuments. The grant is an instrument supporting the performance of the provincial government’s tasks related to the protection and care of monuments. The aim of this article is to assess the statutory regulations authorising the adoption of such resolutions and the content of these resolutions in terms of the voivodeship assembly’s compliance with the limits of the authorisation granted by the legislator. The study verified the hypothesis that individual provincial assemblies use a schematic layout of the content of such resolutions, but only with respect to grant beneficiaries, the purpose of support, and the procedures for granting it. Unconventional regulations were also identified regarding methods of determining maximum subsidy amounts and propaganda formulations generally intended to justify the intention to subsidise work on monuments. A query of the case law of regional audit chambers made it possible to identify elements of the content of resolutions of provincial assemblies that are inadmissible due to the framework of the statutory authorisation to adopt such acts of local law, including those classified as significant violations of law. The resolutions form the basis for periodic calls for grant applications and their verification by evaluation committees.
