Some Remarks on the Contractarian Justification of the Principles of Justice as Set Forth in John Rawls’s Theory

This article analyzes selected aspects of criticism concerning John Rawls’s theory of justice. In particular, this refers to the limitations of those arguments based on the construct of social contract. These limitations are connected with the nature of contract regarding the principles of justice as well as the place and role of justice within the structure of hypothetical agreements setting forth the rules governing cooperation between the members of a given society. This restricts the multitude of contract conditions and circumstances in which intuitive beliefs about justice are formulated. Consequently, the argument referring to the principles of justice that were to express intuitive beliefs about justice becomes limited to those issues involving benefits gained by entities who enter into agreements concerning these principles.
