From Kant to kelsen: the Formal Side of the Theory of the Law

Abstract

This article investigates the much-commented affinity between Kant’s and Kelsen’s theories of law, emphasizing the „formalism” issue. How can a formal treatment of law survive Kelsen’s relativist arguments? This is examined though the scrutiny of the connections between rules and action in the Kantian and Kelsenian frameworks.
