Klimatyczne spory sądowe. Globalny fenomen w prawnej ochronie klimatu
Abstrakt
Celem artykułu jest przedstawienie globalnego fenomenu klimatycznych sporów sądowych (climate litigation), w tym definicji oraz typologii takich sporów oraz ich podstawowej charakterystyki. Termin ten jest zwykle rozumiany jako sprawy przed organami sądowymi i quasi-sądowymi, w których podnoszona jest istotna kwestia faktyczna lub prawna dotycząca łagodzenia zmiany klimatu, adaptacji do zmiany klimatu lub nauki o zmianach klimatycznych. Liczba tak rozumianych postępowań stale rośnie (w 2022 r. było ich 2180 w 65 jurysdykcjach). Jest to już obecnie zjawisko o charakterze globalnym, dające się odnotować na sześciu kontynentach, przejawiające się w sporach na poziomach międzynarodowym, regionalnym i krajowym. Można zatem zaproponować ich typologię na klimatyczne spory sądowe na forach: (i) międzynarodowych, (ii) regionalnych oraz (iii) krajowych. Pochodną rozróżniającego kryterium właściwego sądu (forum) jest najczęściej właściwe prawo, którego dotyczy spór (międzynarodowe, tworzone przez organizacje regionalne lub krajowe). Klimatyczne spory sądowe nie są sporami dotyczącymi wyłącznie interpretacji i stosowania prawa klimatycznego. Dla celów ochrony klimatu w sporach tych wykorzystywane są normy różnych obszarów prawa.
