The right of refugees to international protection in European Union law

Abstract
The provisions of EU legislation, as well as the indicated case law of the European Court of Human Rights, leave no doubt as to the responsibility of the state towards an individual who expresses the intention to apply for international protection. Foreigners seeking international protection must not be returned to a country where they are put at risk of persecution or inhuman or degrading treatment. These circumstances may be verified thanks to the implementation of the principle of non-refoulement, which in turn is related to ensuring access to an effective and lawful procedure on the host country’s territory. On the other hand, in the light of international law, states relying on the principle of sovereignty have the right to protect their borders and decide whom to allow entry in their territory. Difficulties in interpreting and applying both principles create a tension that determines the treatment of foreigners applying for international protection. In the absence of relevant case law of the Court of Justice of the European Union, the European Court of Human Rights attempts to clarify doubts relating to the scope of rights enjoyed by foreigners entering a state party’s territory. The purpose of this article is to analyze the right of refugees to international protection in the light of European Union law and to attempt to assess its effectiveness.
