Abstract
The subject of the article is the analysis of the relationship between the Nature Protection Act and the Monument Protection and Care Act concerning the removal, destruction, or damage of trees and shrubs growing on properties entered in the register of monuments. In a broader scope, the study concerns the relationship between the protection of monuments and the protection of nature. The basic problem is to find an answer to the question about the competence of the authorities, their competencies, the admissibility of specific behaviors towards vegetation, and legal liability. We emphasize the difference between the situation when the removal of trees and shrubs from such properties requires a permit and when a permit from the provincial conservator of monuments is required. In our conclusions, we indicate that in the event of the removal of trees or shrubs from a park or garden entered in the register of monuments, Article 36, paragraph 1, item 1 of the Act on Monuments should be considered lex specialis concerning Article 83a, paragraph 1 of the Act on Nature Protection, which in turn, based on the principle of lex specialis derogat legi generali, requires us to assume that Article 83a, paragraph 1 of the Act on Nature Protection or any of the provisions of this Act related to it do not apply, but only Article 36, paragraph 1, item 1 of the Act on Monuments. On real estate (or parts thereof) entered in the register of monuments, but other than parks, gardens, or other forms of designed greenery, the situation is fundamentally different. On them, the principle of lex specialis derogat legi generali also applies, but in a way the other way round: here, lex specialis is the Act on Nature Protection.
