The impact of the form of performing procedural activities and the course of criminal proceedings on the risk of secondary victimisation among minor victims – selected results of case file research
Abstract
The article presents selected aspects of the research carried out within the research project entitled Influence of the form of conducting procedural actions and the course of criminal proceedings on the risk of secondary victimisation of minor victims – file research. The study was conducted in district and circuit courts located in five court appeals – Gdańsk, Białystok, Warsaw, Wrocław and Poznań. A total of 197 legally completed cases concerning crimes penalised under Article 197 § 3 points 2 and 3, Article 200 and Article 200a of the Penal Code were analysed. On the one hand, the purpose of the article is to present selected data collected during the conduct of the research concerning, among other things, the authorities receiving the notification, the subjects filing the notification, the mode of interrogation of underage victims used, the timing of the interrogation of underage victims, or the number of interrogations conducted in individual cases. On the one hand, and on the other, to indicate and discuss, in the context of the psychological research conducted, aspects of the impact of the minor victim’s involvement in the procedural activities on the risk of secondary victimisation and the occurrence or exacerbation of symptoms of the trauma experienced, which was the experience of sexual abuse. The data presented in the article show how important the behaviour of those who are around the child is, and should take steps to protect him, ensuring that the course of the criminal procedure is tailored to the individual needs of the child, has an impact on the risk of secondary victimisation and the occurrence or exacerbation of symptoms of trauma. Effective use of institutions introduced into the legal order to protect minors requires care for the proper sequence of procedural actions, prudent planning and execution of these actions in time, and above all, involvement and properly formed competences of persons systematically involved in the analysed area of criminal proceedings.
