Financing of subsidized contracting authorities from the perspective of public interest protection
Abstract
In the catalogue of entities obliged to apply public procurement regulations, subsidised contracting authorities constitute a specific category. These are entities from outside the public sector, whose status of a contracting authority results solely from the characteristics of the contract being awarded. One of the conditions for obtaining the status of a subsidised contracting authority is financial support for a given construction work or service connected to it in excess of 50% from public funds or by specific entities from the public sector. The aim of the article is to analyse the condition of public financing of subsidised contracting authorities from the perspective of the public interest. Two key issues are analysed: 1) the scope of protection of the public interest implemented in a situation where a given contract is financed mostly from public sources, but its value is lower than the threshold determining the obligation to apply public procurement procedures; 2) the issue of connection with the public interest of subsidised contracting authorities in the case of financing a given contract by entities that do not have public funds at their disposal.
Regarding the first of these issues, the author concludes that this solution should be considered appropriate from the perspective of the correctness of the directive implementation process, but it may lead to a situation in which construction works co-financed to a significant extent from public sources will be excluded from the public procurement regime, which may pose a threat to the public interest. Regarding the second problem, the key issue is the requirement for the tightness of the public procurement system and the qualification of the entity from which the subsidies originate to the group of public contracting authorities, which sufficiently justifies the connection of such factual situations with the public interest.
