The administrative conditions for exporting monuments outside the Republic of Poland – remarks on the competences of the provincial conservator of monuments

Abstract
The article under discussion herein sets out to analyse the position of the provincial conservator of monuments in the Polish cultural heritage protection system, and more specifically, the narrow scope of competence to decide on the possibility of exporting monuments abroad. The considerations underpinning this approach are primarily rooted in the dogmatic-legal method, with a focus on three key areas: firstly, the justification for the regulation of the export of cultural goods; secondly, the analysis of the conditions for the export of monuments from Poland; and thirdly, the identification of methods through which the provincial conservator of monuments can oversee the implementation of decisions that authorise the export of monuments from the country.
The presentation of the problem takes into account the provisions of international law relevant to the construction of the Polish model of national heritage protection, contained primarily in UNESCO and Council of Europe documents, as well as in European Union law. The conclusions were formulated after an independent assessment of the regulations adopted in both the Polish system and the aforementioned cultural heritage protection systems. The primary position advanced is the proposal for Poland to ratify the Council of Europe Convention on Offences relating to Cultural Property, adopted in Nicosia in 2017.
