The pushback procedure in light of the Polish-Belarusian border crisis. A voice in the discussion

Abstract

The purpose of the article is an attempt to present synthetically the current situation on the Polish-Belarusian border in the aspect of the pushback procedure in comparison with the violation of fundamental human and civil rights. The author shows and evaluates legal-administrative aspects of the pushback procedure by analysing the provisions of domestic law and judicial decisions concerning this process. In conclusion, he points out that it is impossible to unequivocally assess whether the pushback procedure used by Polish services guarding security and public order at the border is applied in disregard of the principles protecting human and civil rights. Certainly, some of the foreigners who have arrived at the Polish-Belarusian border are seeking international protection and access to safe and effective refugee procedures. On the other hand, considering the current situation on the border and frequent incidents related, for example, to attacks on Polish border guards, one can risk a statement that this is an element of hybrid warfare aimed at negatively influencing and destabilizing the situation in Poland. In this regard, the priority of the Polish state should be the creation of conditions to ensure internal order and security on the territory of the Republic of Poland, while providing refugees with the appropriate procedures under national and international law.
