On the dualism of quality control in nursing education in the context of deregulation

Abstract
The forms of education in various professions and specialisations have changed over the years, as have the models of control over this process. Control over fields of study granting special privileges, including professions of public trust, has been and remains particularly strict. Against the backdrop of such regulations and a unified model of quality control in higher education based on the activities of the Polish Accreditation Committee, only two fields of study stand out: nursing and midwifery. In their case, as a result of the evolution from secondary vocational education to higher education, with substantive supervision by the professional self-government and the Ministry of Health, a dual system of control has developed. In parallel with the standard procedure, these fields are additionally supervised by the National Accreditation Council for Nursing and Midwifery Schools. This model creates organisational difficulties for universities and raises doubts about equal treatment. It undermines the principles underlying the establishment of the Polish Accreditation Committee by making unnecessary exceptions to the rule. Moreover, it is contrary to the constitutional principle of equality. A solution to this problem, which has not been noticed on a wider scale, could be a minor amendment to the regulations on science and higher education, which the author urges and proposes. The aim of this study is therefore to analyse the statutory provisions, interpret them, including their purpose, critique them and propose possible amendments that could be adopted by the legislator. The argument is based on a dogmatic-legal and historical-legal method. It is based on literature in the field of higher education and science law, constitutional and administrative law, and legal acts in force as of 15 May 2025.
