Abstract

The discussion about Pope Francis’ Apostolic Exhortation Amoris Laetitia has unfortunately
been focused on its eighth chapter so that many valuable and important impulses get lost.
However it is a fact that the Pope’s statement that divorced and remarried people don’t live in the
state of mortal sin in every case and if so they can receive the sacraments under some conditions,
seems to be contrary not only to the foregoing Catholic discipline but also to the Catholic teaching
on marriage. There are three open questions in this article: the meaning of sin, the status of the second
marriage after divorce and the pastoral consequences of the new propositions. It seems that the
new pastoral proposals will remain in accordance with the Catholic teaching and Tradition only on
condition that the focus will be focus on the question of the validity of the first marriage and on
seeking new solutions. An underestimation or exclusion of these questions and the sole focus on the
condition of the second marriage and on the new moral obligations resulting from it will make the
preservation of the Catholic teaching on marriage impossible.
